PART I — TERMS OF USE

These Terms of Use govern your access to and use of the Live Smart Electric & Solar website, including its assessment, scorecard, booking tools, forms, content, and other online services (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Live Smart

The Site is operated by Live Smart Construction, doing business as Live Smart Electric & Solar ("Live Smart," "we," "us," or "our"). You may contact us at [email protected] or by mail at 200 N. Industrial Park Rd, Unit A2, Excelsior Springs, MO 64024.

2. Eligibility and Permitted Use

You may use the Site only for lawful personal or legitimate business purposes and only if you are legally capable of agreeing to these Terms. You agree that information you submit will be accurate to the best of your knowledge.

You may not:

  • Interfere with the Site, its security, or its operation;
  • Attempt to access systems, accounts, or data without authorization;
  • Introduce malicious code, overload the Site, or use it to distribute unlawful material;
  • Use automated tools to scrape, copy, monitor, or disrupt the Site without written permission;
  • Submit false, misleading, fraudulent, or impersonated information; or
  • Use Site content, assessment results, logos, or materials in a misleading or unauthorized commercial manner.

3. Information on the Site

We work to keep the Site helpful and current, but Site content is provided for general informational purposes. It is not a substitute for an on-site inspection, code inspection, engineering advice, professional electrical evaluation, roofing evaluation, energy-production guarantee, or written estimate. Availability, service areas, pricing, promotions, equipment, recommendations, and scheduling may change and remain subject to confirmation by Live Smart.

4. Free Home Resilience Scorecard

The Free Home Resilience Scorecard is based on the answers you provide. It is an educational screening tool only. It does not inspect equipment, verify installation quality, diagnose a condition, confirm code compliance, identify every potential hazard or shortcoming, or replace advice from a qualified professional.

A score, personalized finding, or recommendation is not a professional Home Resilience Report™, warranty, certification, promise of safety, or guarantee of any result. Recommendations may be generated through preset scoring and decision rules and may not address conditions that cannot be observed through an online questionnaire.

5. Estimates, Booking, and Services

A request for information, assessment result, online booking request, appointment request, or preliminary price range is not a contract for services. We use Housecall Pro and its booking service to help manage appointments, estimates, payments, memberships, service records, and customer communications. Final scope, price, schedule, warranty terms, and other service terms are determined through Live Smart's normal estimating, inspection, and contracting process.

Online availability is not guaranteed until confirmed. We may decline, reschedule, or cancel a request when reasonably necessary because of service-area limits, safety concerns, staffing, weather, equipment availability, incomplete information, or another legitimate business reason.

6. Protection Plans and Other Offers

Protection-plan descriptions and promotional offers displayed on the Site are summaries. Enrollment is subject to the specific plan scope, exclusions, price, renewal terms, cancellation terms, and acknowledgment presented before purchase. Unless expressly stated in a written agreement, a preventive-maintenance or inspection membership is not an equipment warranty, repair policy, emergency-service agreement, or guarantee of system performance.

Discounts, complimentary diagnostic visits, installation promotions, and other offers are subject to their stated limits and may not be combined unless expressly permitted. A complimentary diagnostic visit does not include repair work, parts, permits, emergency service, or after-hours service unless the applicable written plan expressly states otherwise.

7. Communications and Optional Marketing Consent

If you provide contact information, we may send the information, scorecard, appointment response, estimate, service update, or other communication you request. If you separately choose to hear from us, Live Smart may contact you by email, text message, or telephone using the contact information you provide.

Marketing consent is optional and is not a condition of receiving a Free Home Resilience Scorecard, requesting information, or purchasing goods or services. Message frequency may vary and message and data rates may apply. Reply STOP to opt out of promotional text messages and HELP for help. Use the unsubscribe link to stop promotional email, or ask us to stop promotional calls. We may continue sending nonmarketing communications reasonably necessary for an active appointment, project, transaction, account, safety matter, or customer-service request.

8. User Submissions and Feedback

You retain ownership of information and materials you submit. You grant Live Smart a limited right to use, store, reproduce, and process those materials as reasonably necessary to respond to you, provide requested services, operate the Site, maintain business records, and exercise the rights described in the Privacy Policy.

If you voluntarily provide suggestions or general feedback about the Site or our services, we may use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

9. Our Content and Trademarks

The Site's text, design, arrangement, logos, photographs, graphics, videos, assessment questions, scorecard logic, recommendations, reports, and other materials are owned by or licensed to Live Smart and are protected by intellectual-property laws. You may view and use Site content for your own lawful evaluation of our services. You may not reproduce, distribute, modify, publish, sell, license, or commercially exploit Site content without our written permission.

10. Third-Party Services and Links

The Site may link to or use third-party services, including Housecall Pro, Google, Meta, payment processors, map providers, review platforms, social-media services, embedded media, and communications vendors. Their services are governed by their own terms and privacy practices. Live Smart is not responsible for third-party content, availability, security, or conduct outside our reasonable control.

11. Website Availability and Changes

We may modify, suspend, restrict, or discontinue any part of the Site at any time. We do not promise that the Site will always be available, uninterrupted, complete, current, secure, or error-free. We may update these Terms by posting a revised version with a new effective date.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS GENERAL INFORMATIONAL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT EXPRESS OR IMPLIED WARRANTIES. LIVE SMART DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY TO THE EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes a written warranty or obligation that Live Smart expressly provides in a separate signed service agreement or that cannot lawfully be excluded.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LIVE SMART AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS GENERAL INFORMATIONAL CONTENT. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Live Smart harmless from third-party claims, liabilities, losses, and reasonable expenses arising from your unlawful misuse of the Site, your violation of these Terms, or information or materials you submit in violation of another person's rights. This provision does not require you to indemnify Live Smart for Live Smart's own unlawful conduct.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal proceeding concerning these Terms or the Site must be brought in a state or federal court having jurisdiction over Clay County, Missouri, and the parties consent to that jurisdiction and venue.

16. Severability, Waiver, and Entire Agreement

If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the agreement governing use of the Site, but they do not replace the terms of a separately signed estimate, service agreement, protection-plan agreement, financing agreement, or other customer contract.

PART II — PRIVACY POLICY

This Privacy Policy explains how Live Smart Construction DBA Live Smart Electric & Solar collects, uses, discloses, retains, and protects information when you visit the Site, complete the Free Home Resilience Scorecard, request an estimate or appointment, enroll in a protection plan, use a booking feature, or communicate with us.

1. Information We Collect

Information You Provide

Depending on how you interact with us, we may collect:

  • Name, email address, telephone number, mailing or service address, ZIP code, and preferred contact method;
  • Details about your home, business, electrical system, solar system, battery system, generator, equipment, project, or service request;
  • Assessment answers, resilience score, personalized findings, recommendations, and related form and consent records;
  • Appointment requests, estimates, proposals, invoices, transactions, protection-plan information, service history, communications, and feedback;
  • Photographs, equipment information, inspection findings, and job documentation;
  • Payment-related information processed through authorized service and payment providers; and
  • Other information you voluntarily provide.

Please do not submit confidential or sensitive information through a general website form unless it is reasonably necessary for the service you request.

Information Collected Automatically

When you visit the Site, we and our providers may automatically collect:

  • Internet Protocol address, browser type and version, device type, and operating system;
  • General or approximate location;
  • Pages viewed, buttons or links selected, forms used, and other interactions;
  • Date, time, duration, and frequency of visits;
  • Referring website, search engine, advertisement, campaign, or source;
  • Cookie, pixel, tag, advertising, and conversion identifiers; and
  • Website performance, security, error, and diagnostic information.

This information may be collected through cookies, pixels, tags, scripts, local storage, server logs, software tools, and similar technologies.

2. Cookies, Tracking Technologies, and Website Tools

We may use the technologies below to operate and secure the Site, provide requested features, understand performance, and measure advertising. The specific tools enabled may change as our website and business evolve.

Essential Website and Platform Technologies

Our website platform, hosting provider, content-delivery providers, security services, and related vendors may use essential cookies and technical data to display the Site, maintain security, detect fraud or abuse, process forms, remember necessary settings, manage traffic, and improve reliability. Essential technologies may operate without optional cookie consent where permitted by law because they are necessary to provide the Site or a feature requested by the user.

Housecall Pro

We use Housecall Pro and its booking, scheduling, customer-management, communication, payment, membership, and related service features. Housecall Pro may process names, addresses, contact details, appointments, service and equipment information, estimates, invoices, membership records, payment information, communication preferences, and customer history on our behalf and under its applicable privacy and security practices.

Google Analytics 4

We may use Google Analytics 4 to understand how visitors interact with the Site. It may collect pages viewed, time spent, interactions, referring sources, device and browser characteristics, approximate location, and general usage patterns. We use this information to evaluate Site performance and improve the customer experience.

Google Signals

If enabled, Google Signals may allow Google Analytics to associate certain Site activity with users who are signed into a Google account and have enabled advertising personalization. Google may provide aggregated demographic, interest, cross-device, or advertising information. We do not receive a visitor's Google account credentials through Google Signals.

Google Tag Manager

We may use Google Tag Manager to deploy and manage analytics, advertising, conversion-measurement, and website tags. Google Tag Manager primarily manages other technologies; tags deployed through it may collect information as described in this Policy.

Google Ads and Conversion Tracking

We may use Google Ads conversion tracking to measure whether visitors take actions after viewing or selecting an advertisement, including visiting a webpage, submitting a form, requesting an estimate, booking an appointment, calling us, or completing another designated conversion event. We use the results to measure and improve campaign effectiveness.

Google Marketing Platform, DoubleClick, and Floodlight

We may use Google advertising technologies, including DoubleClick or Floodlight, for advertising measurement, attribution, conversion tracking, audience measurement, frequency management, and performance analysis. Depending on configuration and consent choices, these technologies may use cookies or advertising identifiers to recognize a browser or device.

Meta Pixel

We may use the Meta Pixel and related Meta technologies for Facebook and Instagram advertising. These technologies may measure page visits, form submissions, estimate or appointment requests, button selections, and other conversion events after a person views or interacts with a Meta advertisement. We use the information to measure performance and refine campaigns or audiences where permitted. Meta may process information under its own privacy practices and may associate activity with a Meta account depending on the user's settings.

Google Fonts

The Site may use the Google Fonts application programming interface to display fonts. When a font is retrieved from Google servers, Google may receive limited technical information such as an IP address, browser information, and the requested font file.

Embedded Content and Third-Party Features

The Site may include maps, videos, scheduling tools, social-media features, review widgets, payment tools, or other embedded third-party content. When you interact with these features, the provider may receive technical and usage information and may use its own cookies or tracking technologies.

Open Graph Metadata

We may use Open Graph metadata to control how webpages appear when shared through social media, text messages, or other services. Open Graph metadata does not itself collect personal information, although the service through which a page is shared may collect information under its own policy.

Priority Hints and Performance Technologies

The Site may use Priority Hints and similar browser-performance technologies to improve loading speed and prioritize important website resources. These technologies do not ordinarily identify a person by themselves.

3. Cookie Choices and Consent

Where required by law, we will request consent before activating nonessential analytics or advertising technologies. Depending on available Site controls, you may be able to accept, reject, or manage categories of cookies. You can also control cookies through browser settings. Blocking or deleting cookies may affect Site functionality. Essential technologies may continue to operate when necessary for requested services, security, or core functionality.

You may manage Google advertising preferences through your Google account and Meta advertising preferences through your Meta account.

4. How We Use Information

We may use collected information to:

  • Provide the scorecard and personalized findings; respond to questions; and schedule or perform requested services;
  • Prepare inspections, estimates, proposals, reports, invoices, and service records;
  • Administer appointments, projects, transactions, protection plans, customer accounts, and support;
  • Communicate about requested services, appointments, estimates, projects, account activity, safety issues, and customer care;
  • Contact you by email, text, or telephone when requested, authorized, or otherwise permitted by law;
  • Send promotional communications consistent with your choices and applicable law;
  • Operate, maintain, secure, personalize, analyze, and improve the Site, services, operations, advertising, and customer experience;
  • Measure campaigns, conversions, referrals, and business performance;
  • Prevent fraud, spam, abuse, and security incidents;
  • Enforce agreements and protect legal rights; and
  • Comply with applicable laws, regulations, court orders, and legal process.

5. Email, Telephone, and Text Communications

If you provide contact information and authorize communication, we may contact you by email, telephone, or text regarding your inquiry, scorecard, estimate, appointment, service, project, account, protection plan, customer support, or promotions where permitted.

Consent to receive marketing communications is not a condition of purchasing goods or services. Message and data rates may apply; message frequency varies. Reply STOP to opt out of promotional texts and HELP for help. Use the unsubscribe link to stop promotional email or contact us to request that promotional calls cease.

We may continue sending nonpromotional communications reasonably necessary for an appointment, project, transaction, account, warranty-related request, protection-plan membership, safety issue, or customer-service matter.

6. How We Disclose Information

Service Providers

We may disclose information to vendors that support website hosting and development, Housecall Pro services, booking and scheduling, customer relationship management, email, telephone and text communications, payment processing, data storage, security, analytics, advertising, accounting, legal, insurance, and other operations. Providers may process information to perform services for us or as otherwise permitted by their agreements and privacy policies.

Advertising and Analytics Providers

Google, Meta, and other analytics or advertising providers may receive website, device, cookie, conversion, or advertising information when their technologies are enabled. Although we do not sell customer lists, certain privacy laws may define some advertising-related transfers as "sharing," "targeted advertising," or a "sale" even when no money is exchanged. Where required, we will provide applicable choices.

Legal, Safety, and Business Disclosures

We may disclose information when reasonably necessary to comply with law, regulation, subpoena, court order, or legal process; cooperate with authorities; investigate fraud, abuse, or security threats; protect the rights, safety, property, or security of Live Smart or others; establish or defend a legal claim; or facilitate a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.

7. We Do Not Sell Customer Information

Live Smart does not sell customer names, telephone numbers, email addresses, service histories, assessment answers, or customer records for monetary compensation. We do not provide customer contact information to unrelated businesses for their independent direct-marketing lists.

Our use of Housecall Pro, Google, Meta, website providers, payment processors, communications vendors, and other service providers supports our operations, customer service, analytics, or advertising and is not a sale of customer lists. Because some jurisdictions use broader definitions of "sale" or "sharing," you may contact us to exercise an applicable opt-out right.

8. Data Retention

We retain information as long as reasonably necessary to provide requested services, maintain customer and service records, administer protection plans, complete transactions, satisfy tax, accounting, insurance, licensing, warranty, and legal obligations, resolve disputes, enforce agreements, prevent fraud, and support legitimate operations. Retention varies by information type and purpose. When information is no longer reasonably necessary, we may delete, de-identify, or retain it as permitted or required by law.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect information. Measures may include access restrictions, password controls, multifactor authentication where available, encryption where appropriate, secure providers, system maintenance, access limitations, and security monitoring. No website, transmission, database, or storage system can be guaranteed completely secure, and we cannot promise absolute security.

10. Your Privacy Rights and Choices

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • Request access to personal information we maintain about you;
  • Request correction of inaccurate information;
  • Request deletion of certain information;
  • Withdraw consent where processing is based on consent;
  • Object to or restrict certain uses;
  • Request a portable copy of certain information;
  • Opt out of certain targeted advertising, sale, or sharing practices;
  • Unsubscribe from promotional communications; and
  • Receive equal service and pricing without unlawful discrimination for exercising a privacy right.

An authorized agent may submit a request where permitted, but we may require proof of authorization and identity verification.

11. Children's Privacy

The Site and services are intended for property owners, business representatives, and adults seeking electrical, solar, generator, construction, or related services. The Site is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. Contact us if you believe a child has provided information so we can review and address the situation.

12. External Websites

The Site may contain links to websites or services operated by others. We do not control and are not responsible for their privacy, security, content, or practices. Review the privacy policy of any external service you use.

13. International Visitors

Live Smart is based in the United States. If you access the Site from another country, information may be processed and stored in the United States or another location where our providers operate. Where applicable, we process information based on consent, contractual necessity, legal obligations, and legitimate interests in operating, securing, analyzing, and improving our business.

14. Accessibility and ADA Commitment

Live Smart is committed to providing an accessible website experience for users, including individuals with disabilities. We make ongoing, good-faith efforts to improve accessibility and usability with reference to generally recognized practices, including the Web Content Accessibility Guidelines where reasonably applicable.

15. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in services, technology, vendors, practices, or legal obligations. The revised policy will be posted with an updated effective date. Your continued use of the Site after an update is posted is subject to the revised policy.
